Doha – The Appellate Division of the Investment and Trade Court upheld the judgment of the Court of First Instance, ordering a passenger transportation company, its driver, and the insurance company to jointly and severally pay compensation of QAR 500,000 to an individual who sustained injuries in a traffic accident while riding in a vehicle operated by the company.
The claimant filed a lawsuit through his legal representative, lawyer Noora Sarhan, seeking an order against the transportation company, the driver, and the insurer to pay QAR 3 million in compensation for the material and moral damages he suffered as a result of the accident.
According to the statement of claim, the claimant was visiting Qatar and was travelling in a vehicle operated by the transportation company when he was involved in a traffic accident on 30 May 2024. The accident occurred due to the driver’s negligence, resulting in serious injuries.
The claimant suffered multiple injuries, including fractures to the spine, partial amputation of a finger on his left hand, and partial hearing loss caused by a ruptured eardrum. He also incurred substantial medical expenses both within and outside Qatar and suffered loss of additional income due to his inability to work during his recovery.
The claim further stated that a final criminal judgment had been issued convicting the driver responsible for the accident. As no appeal was filed against that judgment, the driver’s liability was conclusively established, together with the joint liability of the transportation company and the insurer of the vehicle for the resulting material and moral damages. Consequently, the claimant initiated civil proceedings seeking compensation.
The claimant’s legal representative submitted documentary evidence in support of the claim, including the accident report and documents relating to the vehicle.
The Court of First Instance ruled that the transportation company, its driver, and the insurer were jointly and severally liable to compensate the claimant in the amount of QAR 500,000 for the damages sustained.
The defendants appealed the judgment. The Appellate Division accepted the appeal on procedural grounds but dismissed it on the merits, thereby affirming the judgment of the Court of First Instance.
In its reasoning, the Court held that the lower court’s judgment was consistent with the law and supported by sound and sufficient grounds. The Appellate Division adopted those grounds as supplementary reasons for its own judgment, noting that the Court of First Instance had fully examined the facts of the dispute and the evidence presented.
The Court further stated that the appellants had failed to provide any arguments capable of undermining the validity of the judgment or affecting the legal and factual basis upon which it had been rendered. Accordingly, the appeal was dismissed and the appealed judgment was upheld.
